In a stunning turn of events, former FBI Director James Comey has been indicted, just days after President Donald Trump publicly urged the attorney general to take action against his political adversaries. This indictment, which was announced on Thursday, includes two serious charges: making a false statement and obstruction of justice.
Attorney General Pam Bondi, in a statement shared on social media, emphasized that the indictment underscores the Department of Justice's dedication to holding individuals in positions of power accountable for misleading the American public. She asserted, "We will follow the facts in this case," although she did not specifically mention Comey by name.
The charges against Comey are rooted in his testimony during a Senate Judiciary Committee hearing on September 30, 2020. When questioned by Senator Ted Cruz from Texas about his previous statements made in 2017—where he claimed he had not authorized any leaks regarding the FBI's investigations into President Trump or former Secretary of State Hillary Clinton—Comey firmly replied, "I stand by the testimony."
However, Comey's former deputy, Andrew McCabe, has claimed that Comey did indeed authorize him to leak information to the media, as detailed in a 2018 report from the Justice Department's inspector general. Interestingly, while the report confirmed McCabe's misleading statements, it also highlighted the complexities surrounding the case.
With the statute of limitations for these charges set to expire soon, Comey could potentially face up to five years in prison if found guilty. He has also granted pardons to over 1,000 individuals charged in connection with the January 6 Capitol attack and has openly pressured Attorney General Pam Bondi to investigate his critics.
Lindsey Halligan, the newly appointed acting U.S. attorney for the Eastern District of Virginia, is the one who brought the charges against Comey, despite some reservations expressed by prosecutors in her office. Halligan stated, "The charges as alleged in this case represent a breach of the public trust at an extraordinary level."
Before the indictment, a senior official from the Justice Department revealed to NBC News that career prosecutors in Halligan's office had sent her a memo arguing that there was insufficient probable cause to justify an indictment against Comey.
In a social media post dated September 20, Trump urged Bondi to take action against Comey and other prominent critics, including Senator Adam Schiff and New York Attorney General Letitia James. He expressed frustration, stating, "We can’t delay any longer; it’s killing our reputation and credibility. They impeached me twice and indicted me five times, OVER NOTHING. JUSTICE MUST BE SERVED, NOW!!!"
Later that day, Trump reiterated his stance to reporters, saying, "If they’re not guilty, that’s fine. If they are guilty, or if they should be judged, they should be judged. And we have to do it now."
Halligan was appointed by Trump after he expressed dissatisfaction with her predecessor, Erik S. Siebert, for not pursuing fraud charges against Letitia James. When asked about the potential indictment of Comey, Trump remarked that he believed he could intervene if he chose to, labeling Comey as a "bad person" and a "sick person."
Comey has been a target of Trump's ire since the FBI, under his leadership, initiated an investigation into Russian interference in the 2016 election and any possible connections to the Trump campaign. Following Trump's inauguration, tensions between him and Comey escalated, leading to Comey's dismissal in May 2017, which prompted then-Attorney General Jeff Sessions to appoint Robert Mueller to oversee the Russia investigation.
After his firing, Comey became a vocal critic of Trump, describing him as "unethical" and "untethered to truth" in his 2018 memoir, "A Higher Loyalty: Truth, Lies and Leadership."
During Trump's first term, he directed special counsel John Durham to investigate the origins of the Russia probe, which resulted in criminal charges against several individuals and companies, but notably, Comey was not charged with any crime.
FBI Director Kash Patel commented on the situation, stating that the bureau aims to rectify the "weaponized federal law enforcement" that characterized previous administrations. He described the politicization of law enforcement during the Russia investigation as a "disgraceful chapter in history."
Earlier this year, both the Department of Homeland Security and the Secret Service investigated Comey over a social media post that featured shells arranged to form the numbers "86 47," which some officials interpreted as a call for Trump's assassination. Comey later clarified in an MSNBC interview that he did not intend for the post to provoke controversy and cautioned against the misuse of power that undermines the rule of law.
